Probus Australia 50th Anniversary Wine – Pre-Sale Terms & Conditions
1. Definitions
“Chandon”, “we”, “us”, “our” refers to Domaine Chandon Australia Pty Ltd (ABN 92 006 768 245).
“Customer”, “you”, “your” refers to a person registering for the Probus Australia 50th Anniversary Wine pre-sale.
“Product” means the Probus Australia 50th Anniversary Commemorative Wine offered under this pre-sale.
“Pre-sale” means the advance registration and offer to purchase the Product, subject to these terms.
“Website” means www.chandon.com.au and associated web pages.
2. Eligibility
2.1. Pre-sale registration and purchase is open only to Australian residents aged 18 years or older.
2.2. By registering, you warrant that you are at least 18 years of age. Chandon reserves the right to request proof of age and refuse or cancel any registration or order where this is not provided or verified.
3. Pre-Sale Registration & Offer to Purchase
3.1. To participate, you must create a membership account on our Website, providing accurate contact and payment details.
3.2. By registering, you are making a conditional offer to purchase the Product at the price specified on the pre-sale page, inclusive of GST and any applicable taxes.
3.3. The pre-sale is subject to a minimum combined order of 4,000 bottles across all participating customers. No payment will be processed until this minimum is met.
3.4. Chandon reserves the right to accept or reject any pre-sale registration at its absolute discretion.
4. Minimum Order Requirement & Confirmation
4.1. If the minimum combined order of 4,000 bottles is not reached by 31 January 2026, the pre-sale will not proceed, no payments will be taken, and all registrants will be notified by email.
4.2. If the minimum is reached, all registered customers will be notified by email. This notification will confirm acceptance of your offer, the anticipated date of payment processing, and the estimated delivery timeline.
5. Price & Payment
5.1. The price of the Product is $174 per case of 6 bottles, including shipping, in Australian dollars and inclusive of GST.
5.2. The Product is only available in cases of 6 bottles. Orders can be placed online only, and not at the Chandon Cellar Door or through any other channel.
5.3. Payment will only be processed after confirmation that the minimum order has been reached. You authorise Chandon to charge your nominated credit card on the date specified in the confirmation email.
5.4. Only major credit cards are accepted for payment. All orders and payments must be made online via the Website.
6. Delivery
6.1. Delivery will be made to the address provided at registration. If you need to change your delivery address, you must notify Chandon in writing before the scheduled shipping date.
6.2. Shipping is available to addresses within Australia only, via Australia Post. While we make every effort to ensure timely delivery, delays or transit issues may occur that are beyond our control. Please contact us at club@domainechandon.com.au if you experience any issues and we will do our best to assist.
6.3. The anticipated production and dispatch of the Product is in early to mid-2026, at Chandon’s discretion. This timeline is indicative only and may be subject to change due to production or other factors outside our control. Chandon will make reasonable efforts to notify you of any changes.
6.4. Title and risk in the Product pass to you upon delivery.
7. Cancellations & Refunds
7.1. Prior to confirmation that the minimum order has been reached, you may cancel your registration at any time by contacting Chandon at club@domainechandon.com.au.
7.2. After confirmation and payment processing, cancellations will only be accepted in exceptional circumstances and are subject to Chandon’s discretion.
7.3. If Chandon is unable to supply the Product for any reason (including but not limited to insufficient orders, production delays, or quality issues), you will receive a full refund to your original payment method.
7.4. Any disputes regarding refunds or cancellations will be handled in accordance with Australian Consumer Law.
8. Product Use and On-Sale Prohibition
8.1. The Product is sold for personal use and gifting only. By participating in this pre-sale, you agree that you are purchasing the Product for yourself or as a gift, and not for resale or any commercial purpose.
8.2. You must not offer, sell, or supply the Product for resale or on-sale, whether by retail or wholesale, as you are not licensed to do so under Australian liquor laws.
8.3. Chandon reserves the right to refuse or cancel any order that it suspects is intended for resale or commercial distribution.
9. Product Details & Specifications
9.1. The Product will be a limited release sparkling wine crafted exclusively for Probus Australia’s 50th anniversary and will not be available elsewhere.
9.2. All decisions regarding the wine style, blend, packaging, and labelling are at Chandon’s sole discretion and may be updated or amended without prior notice, provided these do not materially affect the quality or character of the wine.
10. Privacy
10.1. Personal information collected during registration will be handled in accordance with our Privacy Policy, available at /privacy-policy.
11. Marketing Communications
11.1. By registering for the Probus 50th Anniversary Wine pre-sale, you agree to receive email communications from Chandon Australia relating to your order, as well as occasional updates, offers, and news.
11.2. You may unsubscribe from marketing emails at any time by following the instructions in our communications or by contacting us at club@domainechandon.com.au.
12. Product Availability and Maximum Volume
12.1. The Probus 50th Anniversary Wine is a limited, one-off release and total supply is finite.
12.2. Chandon reserves the right to set a maximum total volume available for this pre-sale and may limit the number of cases supplied per customer, club, or order at its discretion to ensure fair and equitable distribution.
12.3. In the event that demand exceeds available supply once the minimum order is reached, Chandon may allocate available stock among customers in such manner as it considers fair and reasonable, which may include reducing the quantity supplied per order or per customer.
12.4. If your order cannot be fulfilled in whole or in part due to limited stock, you will not be charged for any unavailable quantity and will be notified by Chandon as soon as possible.
13. Responsible Service of Alcohol
13.1. Chandon supports the responsible service and consumption of alcohol. It is illegal to sell or supply alcohol to persons under 18 years of age.
13.2. By registering, you confirm you are of legal drinking age and will not supply the Product to minors.
14. Force Majeure
14.1. Chandon will not be liable for any failure or delay in performing its obligations under these terms if such failure or delay is due to circumstances beyond its reasonable control, including but not limited to natural disasters, government restrictions, transport delays, or industrial action.
15. Limitation of Liability
15.1. To the extent permitted by law, Chandon excludes all liability for any loss or damage (direct or indirect) arising from your participation in the pre-sale, except where such loss or damage is due to Chandon’s negligence or wilful misconduct.
15.2. These terms do not exclude, restrict or modify any consumer guarantees, rights or remedies conferred by the Australian Consumer Law or any other applicable law.
16. Variation of Terms
16.1. Chandon may vary these terms and conditions at any time by posting an updated version on the Website. The version in force at the time of your registration will apply to your pre-sale offer.
17. Governing Law
17.1. These terms and conditions are governed by the laws of Victoria, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of Victoria.
